WASHINGTON, DC - A complaint filed in 2019 has recently been satisfied in the eyes of the United States Department of Agriculture (USDA). The agency alleged in a complaint filed on December 9 that Texas-based Mibo Fresh Foods failed to make a full, prompt payment. This was in violation of the Perishable Agricultural Commodities Act (PACA). The total payments, meant for 14 sellers for multiple lots of produce, amounted to $1,861,502.

After the complaint was filed, USDA and Mibo Fresh entered into a Consent Decision and Order wherein Mibo Fresh agreed to pay the unpaid produce sellers listed in the Appendix A to the Complaint and to pay a civil penalty in the amount of $22,500. As a result of Mibo Fresh satisfying the terms of the consent decision and order, the finding that it had committed repeated and flagrant PACA violations was permanently abated without further process and the case has been closed.
